Terms of Use

These Terms govern your use of Dare. If you do not agree, do not use Dare.

Acceptance

These Terms of Use ("Terms") are a legal agreement between you and Nadim Kamal, operating Dare ("Dare", "we", "us", or "our"). They apply to the Dare mobile apps, appdare.com, and related services.

By downloading, accessing, or using Dare, you agree to these Terms and our Privacy Policy. If you use Dare on behalf of another person or organization, you confirm that you have authority to accept these Terms for them.

Eligibility

  • You must be at least 17 years old to use Dare.
  • If you are between 17 and the age of majority where you live, you may use Dare only with permission from a parent or legal guardian and only where lawful.
  • You may not use Dare if you are prohibited from using it under applicable law or if we previously suspended or terminated your account for safety, abuse, or legal reasons.
  • You may not use Dare if you are located in a country or territory subject to applicable sanctions or if you are on a government restricted-party list that prohibits your use of Dare.
  • You are responsible for making sure your use of Dare is lawful where you are located.

The Service

Dare is a social mobile game for asking and answering questions with friends. Some features may include accounts, profiles, rooms, invites, matchmaking, direct messages, in-game chat, virtual items, subscriptions, ads, push notifications, and third-party sign-in or payment services.

We may add, change, suspend, or remove features at any time. We may limit availability by country, platform, age, account status, safety status, or app version.

Some app data may be stored only on your device, by an app store, or by a third-party service. If your device is lost, the app is removed, local storage is cleared, an account is not synced, or a third-party service fails, some content, progress, messages, or settings may not be recoverable.

Matchmaking

Dare may offer matchmaker or similar features that connect you with players, rooms, or groups you may not already know. Matchmaking may use eligibility, region or country, language, app version, availability, game preferences, gameplay activity, privacy settings, blocks, reports, safety status, prior interactions, device or platform signals, and account settings.

For users in the EU, the main parameters used by our matchmaking recommender are game preferences, language, region or country, availability, blocks and safety status, and prior interactions. We may provide settings that let you modify available matchmaker preferences, and we may add, remove, or change those settings as the feature evolves.

We do not intentionally use sensitive traits such as health, biometric identity, race, ethnic origin, religion, union membership, sex-life information, or precise geolocation for matchmaking unless you choose to provide that information in user content or the use is required or permitted for safety, legal, or consent-based reasons.

Where matchmaking involves users who are minors under applicable law, we may apply additional safety controls, default restrictions, visibility limits, contact limits, reporting controls, or advertising limits to support a higher level of privacy, safety, and security.

Matchmaking may connect you with players you do not already know. Use blocking, reporting, and privacy controls, and do not share personal contact information, payment information, addresses, passwords, or other identifying details with players you meet through matchmaking.

Matches are not guaranteed. We may change, limit, pause, or disable matchmaking to protect users, improve match quality, reduce abuse, comply with law, or operate Dare. Blocking, reporting, privacy settings, safety actions, and account status may affect future matchmaking.

Anonymity

Dare is designed so anonymous questions are anonymous to other players. Other players in the room do not receive an in-app asker label, name, avatar, initials, or profile link for an anonymous question. Dare does not offer a paid, opt-in, or support feature that lets other players reveal the asker.

Our systems may associate a question with the account that submitted it so we can operate the game, investigate abuse, enforce these Terms, prevent fraud, comply with law, and protect users. A lawful request, court order, regulator request, safety emergency, or abuse investigation may require internal review or disclosure to an authorized party.

You are responsible for what you write. Other players may guess or infer based on context, timing, writing style, or information you include. Do not put personal, identifying, illegal, or unsafe content in a question or message.

You should not expect questions, room messages, direct messages, reports, or other communications to be private from Dare's safety, support, legal, anti-abuse, and moderation review systems, except as expressly described in these Terms and the Privacy Policy.

Accounts And Security

  • You must provide accurate information where required.
  • You are responsible for activity on your account and for keeping your device and credentials secure.
  • We may treat activity from your account, device, sign-in method, or credentials as activity by you or by someone you authorized, unless applicable law requires otherwise.
  • Do not sell, transfer, share, or let another person use your account.
  • Tell us promptly if you believe your account was accessed without permission.

Acceptable Use

You may use Dare only for lawful, personal, non-commercial entertainment unless we give written permission otherwise. You agree not to:

  • Harass, threaten, bully, stalk, exploit, shame, dox, impersonate, or target another person.
  • Post or send sexual content involving minors, non-consensual intimate content, credible threats, hate content, illegal content, self-harm instructions, or content that invades another person's privacy.
  • Use anonymity to abuse, manipulate, defraud, or evade accountability.
  • Collect, harvest, scrape, disclose, or misuse other users' personal information, including through bots, crawlers, automated tools, spyware, pixels, tags, beacons, passive collection mechanisms, or similar tracking methods.
  • Attempt to identify anonymous askers by technical means, social engineering, reverse engineering, or abuse of app behavior.
  • Interfere with Dare, bypass security or moderation tools, automate access, exploit bugs, defeat encryption or technical controls, use cheats or third-party software, or attempt unauthorized access.
  • Sell, transfer, rent, sublicense, trade, or try to sell or transfer an account, room, invite, virtual item, virtual currency, reward, entitlement, or access to Dare.
  • Offer or use paid boosting, power-leveling, account recovery, moderation evasion, cheating, exploit, or de-anonymization services.
  • Use Dare for spam, advertising, political campaigning, contests, gambling, commercial research, or unlawful solicitation without our written permission.
  • Abuse, threaten, harass, or mislead support, moderation, safety, or operations staff.
  • Violate app store rules, payment rules, intellectual property rights, privacy rights, or any applicable law.

User Content

"User Content" means content you submit, upload, send, create, or make available in Dare, including usernames, profile photos, questions, answers, messages, room names, reports, and feedback.

If you invite someone to Dare or send a Dare-related message through SMS, email, WhatsApp, social media, contacts, share sheets, or another third-party service, you are responsible for making sure the recipient has agreed to receive that message or that the message is otherwise lawful and not unwanted.

You keep ownership of your User Content, but you grant Dare a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, copy, display, transmit, format, adapt, create technical or display-related derivative works from, moderate, remove, and otherwise use your User Content as needed to operate, secure, improve, promote, and provide Dare, work with service providers, and enforce these Terms. This license ends when your User Content is deleted from our systems, except where retention is required for legal, safety, backup, dispute, platform, archival, or already-produced materials.

You confirm that you have the rights needed to submit your User Content and that your User Content does not violate these Terms or anyone else's rights.

Where permitted by law, you waive any moral rights or similar rights you may have in User Content for our permitted uses. Where waiver is not allowed, you agree not to assert those rights against Dare, its service providers, or users in a way that conflicts with these Terms.

We may remove, restrict, or preserve User Content if we believe it violates these Terms, creates risk, infringes rights, or is required by law or platform policy.

User Content already shown to other users may remain in screenshots, notifications, cached views, device storage, backups, or copies outside our control. We cannot guarantee that every copy will be removed from other users' devices or third-party systems.

Safety, Reports, And Moderation

Dare is a social app. We may use automated systems, user reports, manual review, account limits, content removal, blocking tools, privacy controls, and law-enforcement escalation where appropriate. We do not promise to review every item of content or prevent every harmful interaction.

If you see content or behavior that may be illegal, abusive, unsafe, or against these Terms, report it in the app where available or contact support@appdare.com.

For notices about illegal content, safety issues, intellectual-property concerns, or regulator/law-enforcement contact, use support@appdare.com and include enough information for us to locate and review the issue.

We report apparent child sexual abuse material and related child sexual exploitation to the National Center for Missing & Exploited Children's CyberTipline, law enforcement, or other appropriate authorities where required by law.

Where applicable law requires a reasoned notice or appeal path after we remove content or restrict an account, we will provide it through the app, by email, or through another reasonable channel. You may appeal a moderation or account decision by contacting support@appdare.com with the subject line "Dare appeal"; we aim to review appeals within 21 days where reasonably possible.

EU Digital Services Act Contact

For EU Digital Services Act notices from users, Member State authorities, the European Commission, or the European Board for Digital Services, contact support@appdare.com with the subject line "Dare DSA notice". We accept communications in English.

Trusted flaggers may use the same contact channel and should include their trusted-flagger status, the exact content or account at issue, the legal basis for the notice, and enough information for us to review the notice. Where required by law, we provide a statement of reasons when we remove content or restrict an account.

Dare has not been designated as a Very Large Online Platform under Article 33 of the Digital Services Act.

Purchases, Virtual Items, And Subscriptions

Dare may offer purchases, subscriptions, virtual currency, virtual items, cosmetics, or premium features. Purchases are processed by Apple, Google, or another payment provider shown at checkout.

  • Subscriptions renew automatically unless canceled through the platform where you purchased them.
  • You may turn off auto-renewal at any time through your Apple App Store or Google Play subscription settings.
  • Cancellation stops future renewal charges but does not automatically refund past charges or the current billing period unless Apple, Google, or applicable law provides otherwise.
  • Refunds, chargebacks, billing errors, trials, price changes, and subscription management are handled under the rules of the platform or payment provider used for the purchase.
  • Virtual items and virtual currency have no cash value, are not property, and cannot be transferred, sold, exchanged, or redeemed for money unless we expressly allow it in writing.
  • As reflected in California Business and Professions Code section 17500.6, any balance of virtual items, virtual currency, rewards, or similar virtual content does not reflect stored value.
  • We may modify, suspend, or discontinue virtual items or paid features where permitted by law, with any required notice.
  • Except where required by law, app-store rules, or a payment-provider decision, we are not required to restore virtual items, virtual currency, rewards, progress, or entitlements that are lost because of account deletion, termination, device loss, unsupported app versions, local data loss, or third-party platform issues.

If you are in the EEA, UK, or another place with digital-content withdrawal rights, you may have a statutory right to withdraw from certain purchases for a limited period. Where you ask for immediate access to digital content or a subscription benefit, you may lose that withdrawal right or receive only a proportionate refund for the unused portion, as allowed by applicable law and the app-store or payment-provider rules.

Third-Party Services

Dare may rely on third-party platforms and services, including app stores, sign-in providers, cloud infrastructure, analytics, attribution, ads, push notifications, payment providers, and device operating systems. Their terms and policies apply to your use of those services. We are not responsible for third-party services we do not control.

Automated Tools And AI

Dare may use automated systems, rules, machine learning, or AI-assisted tools to help operate the app, provide matchmaking, recommend or organize gameplay, detect fraud, cheating, spam, abuse, safety risks, or technical issues, and support moderation or customer service. These tools are not a promise that every harmful action will be detected or prevented.

Where required by law, decisions that produce legal or similarly significant effects will include appropriate human review or appeal rights.

Our Intellectual Property

Dare, appdare.com, the Dare name, logos, designs, software, gameplay systems, visual style, text, and other materials we provide are owned by us or our licensors and are protected by law. Except as allowed by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from Dare.

If you send ideas, suggestions, or feedback, you allow us to use them without restriction or compensation to you.

Suspension And Termination

You may stop using Dare at any time. You may request account deletion through Delete Your Account or by contacting support@appdare.com.

We may suspend, restrict, or terminate access if we reasonably believe that you violated these Terms, created legal or safety risk, abused other users, infringed rights, attempted fraud, or used Dare in a way that harms users, Dare, or third parties. Where required by law, we will provide notice and an opportunity to appeal.

If your account is deleted, suspended, restricted, or terminated, you may lose access to your account, games, messages, progress, subscriptions, virtual items, virtual currency, rewards, and other data associated with Dare. Except where required by law, app-store rules, or a payment-provider decision, we are not required to restore that access or data.

Before deleting your account or after receiving a termination notice, you may request a copy of personal data that Dare controls where applicable law gives you that right, subject to verification and lawful exceptions.

Inactive Accounts

We may delete or de-identify inactive accounts and related data after 12 months of inactivity, subject to legal, safety, tax, accounting, dispute, backup, and platform obligations. Where reasonably possible and where we have a working contact channel, we will try to provide notice before deleting an inactive account.

Disclaimers

Dare is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not guarantee that Dare will be uninterrupted, secure, error-free, available in every location, compatible with every device, free from harmful user behavior, or that any user content or data will always remain available. You use Dare at your own risk, and you are responsible for keeping your device, credentials, account, and submitted content safe.

No online service, storage system, network, device, app store, or third-party SDK can be guaranteed to be completely secure or always available. To the maximum extent permitted by law, we are not responsible for loss, corruption, unauthorized access, disclosure, deletion, delay, interruption, or unavailability of user content or data caused by events outside our reasonable control, third-party services, user actions, device compromise, platform failure, security incidents, legal process, or force majeure events.

Nothing in these Terms limits rights that cannot be limited under applicable consumer, privacy, app-store, or safety laws.

Limitation Of Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, intentional misconduct, or any liability that cannot be excluded or limited under applicable law.

To the maximum extent permitted by law, Dare and its owners, operators, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, user content, goodwill, reputation, business opportunity, device functionality, or account access.

To the maximum extent permitted by law, we are not responsible for claims, losses, or damages arising from user content, another user's conduct, third-party services, app-store or payment-provider decisions, security incidents outside our reasonable control, unauthorized account access caused by your device or credential security, or legal/safety actions we take in good faith.

To the maximum extent permitted by law, our total liability for all claims relating to Dare or these Terms will be limited to the greater of: (a) the amount you paid to Dare through the app in the 12 months before the claim; or (b) USD $100.

Some jurisdictions do not allow certain limits. In those places, the limits apply only to the extent allowed by law.

Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Dare and its owners, operators, employees, contractors, service providers, licensors, and affiliates from claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees and costs, arising from your User Content, your misuse of Dare, your violation of these Terms, or your violation of another person's rights or applicable law.

Disputes

Before starting a formal claim, you agree to contact us at support@appdare.com with the subject line "Dare notice of dispute" and give us 60 days to try to resolve the dispute informally where allowed by law. Include your account information, a description of the issue, and the outcome you want.

Unless applicable law requires otherwise, these Terms are governed by the laws of Israel, without regard to conflict-of-law rules. This choice of law does not deprive consumers of mandatory protections in their country or state of residence.

Where permitted by law, claims must be brought individually and not as a plaintiff or class member in a class, collective, consolidated, or representative action. This clause does not apply where prohibited by law.

Apple And Google Terms

If you downloaded Dare from the Apple App Store, these Terms are between you and Dare only, not Apple. Apple is not responsible for Dare or its content, and Apple has no obligation to provide maintenance or support for Dare.

If Dare fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app if required by Apple's rules. To the maximum extent permitted by law, Apple has no other warranty obligation for Dare, and any other claims, losses, liabilities, damages, costs, or expenses are our responsibility to the extent required by these Terms and applicable law.

Dare, not Apple, is responsible for addressing product-liability claims, claims that Dare fails to conform to legal or regulatory requirements, consumer-protection claims, and third-party intellectual-property claims relating to Dare or your possession and use of Dare.

You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms for Apple App Store users and may enforce these Terms against you as a third-party beneficiary.

If you downloaded Dare from Google Play or another app marketplace, your use is also subject to that store's terms. The store provider is not responsible for Dare except as required by its own terms and applicable law.

Changes To These Terms

We may update these Terms. If changes are material, we will take reasonable steps to notify you, such as updating the date above, posting a notice, or providing an in-app notice. Where reasonably possible, we will give at least 30 days' notice before material changes take effect. Your continued use after changes become effective means you accept the updated Terms.

Miscellaneous

We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or transfer to an affiliate. You may not assign these Terms without our written consent.

We are not responsible for delay or failure to perform caused by events beyond our reasonable control, including network failures, platform outages, cloud-provider issues, labor disputes, war, terrorism, natural disasters, epidemics, governmental actions, legal process, or security incidents.

If any part of these Terms is found invalid or unenforceable, the remaining parts remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Privacy Policy and any additional terms shown in the app or store listing, are the entire agreement between you and Dare for the service.

Sections about user content, acceptable use, purchases, intellectual property, privacy, termination effects, disclaimers, limitation of liability, indemnity, disputes, app-store terms, and miscellaneous terms survive termination to the extent needed to give them effect.
